Call to Order:

The regular meeting of the Bradley Village Board was called to order on Monday, September 11, 2017 at 6:30 p.m. at the Bradley Municipal Hall. President Adams presided. Roll call: Trustees Balthazor, Watson, Dugan-Roof and Barber. Trustee's Redmond and Gadbois were absent

Agenda:

Mayor added 65 Communications - Smoke testing notification

A motion was made by Trustee Balthazor and seconded by Trustee Dugan-Roofto approve the agenda with the changes made. (4 ayes 0 nays 2 absent) Motion carried

Presentation of Minutes:

A motion was made by Trustee Balthazor and seconded by Trustee Dugan-Roofto approve the minutes of the Regular Board meeting dated August 21, 2017 as printed and presented. (4 ayes 0 nays 2 absent) Motion carried

A motion was made by Trustee Balthazor and seconded by Trustee Barber to approve the minutes of the Regular Board meeting dated August 28, 2017 as printed and presented. (4 ayes 0 nays 2 absent) Motion carried

A motion was made by Trustee Balthazor and seconded by Trustee Dugan-Roofto approve the minutes of the Committee of the Whole meeting dated May 22, 2017 as printed and presented. (4 ayes 0 nays 2 absent) Motion carried

Proclamation Mayor proclaimed September 17 through 23" as Constitution Week

Request from Bradley Lion's to hold their Homecoming Parade on Broadway from Forest Avenue down to Washington October 6, 2017 starting at 5:30 p.m. A motion to approve the parade and road closure was made by Trustee Watson and seconded by Trustee Dugan-Roof (4 ayes 0 nays 2 absent)

Christmas Parade in the Village of Bradley will be held on Friday, December 1, 2017. the theme for the parade will be “Christmas Through a Child's Eyes.”

Mayor read a letter from RJN regarding the Smoke testing that will be done in the West Meadowview area. Smoke testing will start September 12, 2017 this shall last for about 2 to 3 days. If there are any questions, you can go to RJN.com.

Public Communications:

•Duane Brumitt - Business address - 275 N. Industrial Dr. O-9-17-4 Ordinance for Medical Marijuana Dispensary by his Tri-Star Martial Arts 90% of his business are children age 3-16. His concern is you can't have this within 1000 feet of a school. He is opposed to this

•Ronald Kinzinger - 422 N. Kennedy - O-9-17-4 Ordinance for Medical Marijuana Dispensary he is opposed.

Report of Village Officers and Department Heads:

Public Works Director Memenga gave his report for the month of August 2017.

Utilities-

•4 service requests were generated and or closed out in August

Parks-

•Continue installing certified mulch in Playgrounds throughout the Village

•New concrete border installed at Lion's Park

•Prep work began at Blatt Park for new equipment installation

Streets-

•8 service requests were generated and or closed out in August

•Performed 9 enforced mowing requests

•Mosquito Spraying 3x's weekly throughout the Village

•Received and used new brush mower deck

•Filled approximately 39 potholes

•Assisted with 125-year celebration - banners and barricades

General-

•263 Julie locates were received and performed in August

Presentation of Bills and Accounts:

A motion was made by Trustee Dugan-Roof and seconded by Trustee Barber to pay all bills and accounts by recommendation of the Finance Committee. (4 ayes 0 nay 2 absent) Motion carried

Report of Special Committees:

Chairman Smith of the Planning & Zoning Committee was present. The Committee met on Tuesday, September 5, 2017. There were (2) items on the agenda.

1.Public Hearing-the Commission consideration of a request by Regatta Partners, LLC for the issuance of a Special Use Permit for the operation of a medical marijuana dispensary for land commonly known as 265 Stebbings Court, Suite 1, Bradley, IL (Parcel Identification Number 17-09-20-416-015)

All posting and mailing were served as required. There were questions from the public. Steve Wilder was present, he's a Professional Security Consultant and he was worked with other dispensaries and see no problems with this.

John Hengl 271 N. Fulton - he had questions about it being so close to the Library and a bus stop.

Ron Kinzinger was present he opposed this.

Chairman Smith stated that a motion to adopt the finding of fact and recommend approval of the special use permit pursuant to the standards set forth in Section 60-399 (2) of the Zoning Chapter of the Village Code, subsection a through d from or planning and Zoning handbook. (8-1) vote in favor

2. Request by Anchor Construction, LLC for a minor subdivision of land commonly known as 320 S. Kinzie Avenue, Bradley, IL (Parcel Identification Number 17-09-28-303-001)

Matthew Smith Project Engineer was present. The Committee voted finding of fact pursuant to Section 46-47 and approved it on a (9-0) vote in favor

A motion was made by Trustee Watson and seconded by Trustee Barber to approve the Planning and Zoning Commission report. (4 ayes 0 nays 2 absent) Motion carried

Report of Standing Committees:

Ordinance & Technology

1. O-9-17-1 an Ordinance regulating parking along North Street between Pierce Avenue and Cardinal Drive in the Village of Bradley, Kankakee County, Illinois

A motion was made to waive two readings by Trustee Watson and seconded by Trustee Balthazor (5 ayes 0 nays 2 absent) Mayor voted Motion carried

A motion was made to adopt O-9-17-1 by Trustee Balthazor and seconded by Trustee Dugan-Roof (4 ayes 0 nays 2 absent) Motion carried

2. O-9-17-2 an Ordinance regulating Encroachment on certain public Rights of Way In the Village of Bradley, Kankakee County, Illinois

A motion was made to waive two readings by Trustee Balthazor and seconded by Trustee Watson (5 ayes 0 nays 2 absent) Mayor voted Motion carried

A motion was made to adopt O-9-17-2 by Trustee Watson and seconded by Trustee Dugan-Roof (4 ayes 0 nays 2 absent) Motion carried

3. O-9-17-3 an Ordinance approving the subdivision of certain property within the corporate limits of the Village of Bradley, Kankakee County, Illinois

A motion was made to waive two readings by Trustee Balthazor and seconded by Trustee Dugan-Roof (5 ayes 0 nays 2 absent) Mayor voted Motion carried

A motion was made to adopt O-9-17-3 by Trustee Balthazor and seconded by Trustee Dugan-Roof (4 ayes 0 nays 2 absent) Motion carried

4. O-9-17-4 an Ordinance granting a Special Use Permit for the operation of a Medical Marijuana Dispensary on certain premises located within the Village of Bradley, Kankakee County, Illinois (1 reading)

Unfinished Business:

Per Diem for IML Convention - Mayor noted the rates have been based on the US General Services rates for Chicago $259.00 for a full day. The IML Convention in Chicago will be Thursday a 4 of day per diem, Friday & Saturday full day and Sunday 1/2 a day. A motion to allow the per diem was made by Trustee Balthazor and seconded by Trustee Dugan-Roof (4 ayes 0 nays 2 absent) Motion carried

New Business:

R-9-17-1 a Resolution authorizing an Intergovernmental Agreement between the Village of Bradley, Kankakee County, Illinois, and the Illinois Department of Transportation for the purpose of replacing the North Street Bridge over I-57, and other associated work.

A motion was made to adopt R-9-17-1 by Trustee Watson and seconded by Trustee Dugan-Roof (4 ayes 0 nays 2 absent) Motion carried

R-9-17-2 a Resolution appropriating funds to subsidize the replacement of the North Street Bridge and associated roadwork.

A motion was made to adopt R-9-17-2 by Trustee Watson and seconded by Trustee Barber (4 ayes 0 nays 2 absent) Motion carried

R-9-17-3 a Resolution approving the Illinois Department of Transportation's final plans and specifications for the North Street Bridge Project.

A motion was made to adopt R-9-17-3 by Trustee Watson and seconded by Trustee Barber (4 ayes 0 nays 2 absent) Motion carried

Salt Bids - Insurance & Finance Committee Chairman Dugan-Roof noted they received (4) bids for salt this is for 1000 tons.

•Cargill $26,740

•Compass Minerals $28,630

•Morton Salt $30,620

•CONSERVFS $33,245

A motion to approve the Salt bid from Cargill was made by Trustee Dugan-Roof and seconded by Trustee Watson (4 ayes 0 nays 2 absent) Motion approved

Garage Sales discussion - Garage Sales are limited to 2, 3 day sales a year. Mayor noted he had a resident stated that some residents should be able to have as many sales as they want because Some residents rely on the revenue from Garage sales for existence. It was suggested this go to the Ordinance Committee.

Calendar Dates have been provided to the Trustee's to be looked over for approval for the 2018 calendar.

Adjournment:

A motion was made by Trustee Balthazor and seconded by Trustee Dugan-Roofto adjourn the meeting. The meeting was adjourned at 7:15 p.m. on a unanimous aye vote.
