Kankakee County Planning, Zoning, and Agriculture Committee met Nov. 20.

The meeting was called to order by the Committee Chairman, Mr. Fetherling, at 9:00 a.m. Quorum present.
2. Public Comment

3. Approval of Minutes: October 16, 2019
Mr. Payton made a motion to approve the minutes, and Mr. Long seconded it. Motion carried with a voice vote.
4. Building
Building Report – October 2019
Mr. Skimerhorn reviewed both reports for the committee.
Mr. Payton made a motion to combine and approve, Mr. Long seconded it. Motion carried with a voice vote.
Mr. Skimerhorn reviewed the building report with the committee.
Stormwater /MS4 Program Discussion
Mr. Skimerhorn asked the committee if there are any stormwater issues that they would like to discuss or make him aware of.
There were no issues to discuss
Unsafe Structure at 2338 E 10000 N Road, Manteno, IL; Owned by Municipal Trust & Saving Bank Trust #2231/Adam Baumgartner, Trustee – Referral to State’s Attorney’s Office for Remediation
Mr. Skimerhorn advised the committee that this property is on the North side of Manteno Lake. The property has been sitting for at least 2-3 years in the condition that it is in. There is no door, windows broken out, gas line exposed, no subflooring with open access and unsafe porch area.
The home was purchased in 2016 and gutted without permits. The county issued a stop work. The permit was for a demolition. Another stop work was issued when they started a rebuild without a permit.
Mr. Skimerhorn advised that he is advising the committee to refer this issue to the State’s Attorney’s Office for remediation.
Ms. Peters asked about the cost.
Mr. Skimerhorn said an estimate would be $2-4,000 to board up and $10-15,000 to demolish the house.
Ms. Nicholson addressed the committee regarding the process and advised the committee that she would seek the boarding up.
Mr. Kinzinger asked if there would be a lien on the property for that amount.
Ms. Nicholson confirmed and stated that it will be incorporated into the price of the home. Typically, once the proceedings start, the owner sells the property.
Mr. Washington made a motion to approve the State’s Attorney’s Office to move forward and Mr. Dunnill seconded it. Motion carried with a voice vote.
6. Zoning
• ZBA Case#19-13; request for a Text Amendment to County Code Section 121-295 (Siting of Wind Energy Conversion System). The petitioner is Kankakee County.
Mr. Fairfield made a motion to approve, and Mr. Payton seconded it.
Mr. Skimerhorn advised that this amendment is to increase the maximum height to 699 feet. This would also increase the setback to a higher distance. ZBA heard the case and recommended to approve 5-0.
Motion carried with a voice vote.
•ZBA Case#19-06; request for a variance to Section 121-398.4.a, c, d, & e (Billboard) in the C2- General Commercial District on a parcel generally situated in Section 16 of Bourbonnais Township. The petitioner is Jerry Fozzard, property owner & applicant.
Mr. Wheeler made a motion to approve denying the variance as recommended by the Zoning Board of Appeals, and Mr. Kinzinger seconded it.
Mr. Skimerhorn advised the committee that this is a property right in front of Arthur Birch Trailer park. The case has been continued and redone several times. The Zoning Board of Appeals recommended denying the request with a vote of 0-6 to deny.
Mr. Skimerhorn reviewed the request and went through each fact and findings with the committee. This includes the safety aspects of the variance request. There were objectors present at ZBA which included the Villages of Bradley and Bourbonnais.
MS. Peters asked if there was any way that he could have a sign on his property.
Mr. Skimerhorn stated that the property could have a business sign if there was a business that was opened up on the property. Business signs are different.
Motion carried with a voice vote.
•ZBA Case#19-14; request for a Special Use Permit #13c (Single Family Home) in the R1-Single Family Residential District on a parcel generally situated in Section 14 of Bourbonnais Township. The petitioner is Michael Olenick, Jr., property owner & applicant.
Mr. Kinzinger made a motion to approve, and Mr. Smith seconded it.
Mr. Skimerhorn explained and reviewed the request with the committee. Zoning board of Appeals recommended approving and there were no objectors present.
Motion carried with a voice vote.

Rural Transit Update
Mr. Skimerhorn reviewed and updated the committee on the rural transit system.
