The Iroquois County Board met in Recessed Session at 9 A.M. The meeting was conducted in person and electronically, via ZOOM, under Phase 4 of the Governor’s Plan to reopen the State of Illinois and Executive Order 2020-74. The phased opening and executive order were issued in response to the COVID-19 pandemic, they require social distancing measures to be taken to stop the spread of the highly contagious virus and also suspend certain provisions of the Illinois Open Meetings Act to allow for public bodies to continue their course of business during the public health emergency. Chairman Shure called the meeting to order and asked County Clerk Breein Suver to call the roll.

CHAIRMAN COMMENTS

Chairman Shure announced that the I.T. Committee was inadvertently left off the meeting schedule that was disseminated to the Board members. He noted that I.T. will meet in January, February, and March at 9:30 or immediately following the Finance Committee.

Chairman Shure recognized the late Harriett Mowrey for her service on the following: 27 years on the Stockland Township Board, 14 years on the Milford Library Board, 17 years on the Iroquois County Board, 12 years on the Iroquois Memorial Hospital Board, and 4 years on the 911 Board.

Lastly, he wanted to wish everyone a Merry Christmas and Happy New Year.

OUTSIDE ORGANIZATION REPORTS

Mr. McGinnis reported that the I-Kan Regional School Board met remotely. They went over normal reports and talked at length about remote learning throughout the region. Mr. McGinnis also gave the report of the 708 Mental Health Board. At their next meeting they will be passing their annual report and will be discussing allocation of grant monies for the upcoming year.

Chairman Shure gave the report of the Policy & Procedure Committee and moved for adoption. The motion was seconded and carried by a roll call vote.

Your Committee met at the Administrative Center on November 23, 2020 at 9:00 A.M. Members present were County Board Chairman John Shure, Lyle Behrends, Charlie Alt, Barbara Offill and Marvin Stichnoth. Michael McTaggart was absent. Also present Finance Manager Jill Johnson, County Clerk Breein Suver, EMA Director Eric Ceci and Maintenance Supervisor Chris Drake.

The meeting was called to order.

It was moved by Barbara Offill and seconded by Marvin Stichnoth to approve the agenda. Motion carried by a voice vote.

The Committee Chairs gave their monthly reports:

● Management and Judicial chairman Lyle Behrends reported the Management committee will open fertilizer bids and discuss assessment of properties. The Judicial committee will hear their standard reports.

● Health chairman Barbara Offill reported the Health committee will hear their standard reports and receive an update on COVID-19.

● Tax/Planning & Zoning chairman Marvin Stichnoth reported the committee will hear their standards reports and approve the FY20 levy.

● Highway chairman Charlie Alt reported the Highway committee will review and approve resolutions for the County Engineer’s salary and for general maintenance. Highway meetings will be held in the County Board Room until further notice.

EMA Director Eric Ceci reported he continues to receive additional resource requests. EMA still has a stockpile of supplies to be able to help other healthcare entities and emergency responders remain supplied. In addition, an improvement plan was submitted to the state. There are some revisions to be made considering COVID operations. The Starcom radio was installed in the EMA office. There were some issues found during testing. Moving forward, EMA will continue operations with the COVID-19 pandemic and will work on getting reimbursements for the County for COVID items. Ceci said he will also begin working on EOP revisions.

County Board Chairman John Shure informed the committee of the CURES grant funds for Iroquois County government in the amount of $443,841. A special County Board meeting is being held following the Policy & Procedure meeting to discuss the County Clerk’s request for use of the funds. Shure asked if other departments have submitted applications or requests. Finance Manager Jill Johnson stated nothing has been submitted for reimbursement yet but she does have a few items to submit, such as payroll. Other departments can submit their invoices to Johnson and she will submit everything online. All applications must be submitted by December 31st but an extension can be filed for January 31st. County Clerk Breein Suver said she could possibly submit invoices for laptops for employees in the event they become quarantined at home. This would allow them remote access to their work. However, the Recording Office is her biggest concern. The funds being requested at the following meeting will take care of 10 years’ worth of records.

Ceci said he is running low on personal protective equipment (PPE) and could purchase additional equipment through the grant. Another grant that is available to the County is the FEMA public assistance grant. This is a 75% matching grant but it is recommended to use the CURES grant first. Shure suggested Johnson extend the grant deadline to January 31st for the County. In the meantime, the board needs to aggressively pursue this matter.

It was moved by Offill and seconded by Stichnoth to enter into executive session at 9:21 A.M. under statute 5 ILCS 120/2/c1: The appointment, employment, compensation, discipline, performance, or dismissal of specific employees of the public body. A roll call vote was taken. Motion carried.

It was moved by Alt and seconded by Offill to come out of executive session at 9:38 A.M. Motion carried by a voice vote.

Appointments include the reappointment of Matt Lindgren to Zoning Board of Appeals. There was no old business.

Management Services chairman Lyle Behrends opened fertilizer bids as follows: 

• Tri Central Coop $22,013.36 high rate

It was moved by Sherry Johnson and seconded by Zumwalt to accept United Prairie’s low rate fertilizer bid in the amount of $19,954.42. A roll call vote was taken. Motion carried. Behrends informed the committee of the new assessments on the County Farm properties. Johnson questioned how the property taxes are handled with the County Farm. Finance Manager Jill Johnson explained the property taxes are paid by the County and the fertilizer is paid by the tenant. Johnson suggested the tenant should also be responsible for paying the property taxes. Zumwalt recommended a change to the next years County Farm lease to include having the waterway seeded down. Zumwalt said he has been in contact with someone but has not received any costs.

The committee received an update on the solar project with Clean Energy Design Group stating the project has been shut down due to COVID-19.

Maintenance Supervisor Chris Drake’s report included the following:

• On November 21st, the grease trap backed up in the Jail kitchen.

• Issues with the heating system were resolved.

• Drake purchased 2 pallets of salt.

• Drake purchased a floor machine for the Courthouse.

• The door project for the health department is complete.

• The parking lot and doors at the Jail are scheduled as capital improvement projects for 2021. Behrends advised Drake to get bids as soon as possible and to move forward with both projects.

Johnson spoke to Drake about Pureshield air filters for the buildings and the possibility of the COVID-19 grant or the CURES paying the cost. Johnson also spoke about the possibility of being on a regular schedule with Hiltz for pumping.

The committee reviewed the claims. It was moved by Johnson and seconded by Bowers to pay the claims, subject to County Board approval. A roll call vote was taken. Motion carried.

During old business, the committee discussed Headstart’s progress on moving out. Drake reported they have everything packed and ready to move. Finance Manager Jill Johnson added that they are waiting to move everything into storage and will bring their keys to the Finance Office once they have moved.

ICPHD Administrator Dee Schippert informed the committee the former breakroom is being utilized for contact tracing for 5 staff members and she will eventually move the Environmental Health staff into the room.

The air filters discussed earlier in the meeting were brought to Schippert’s attention. Schippert said she wouldn’t be opposed to the idea.

Schippert gave an update on the release of the COVID-19 vaccine stating it will come out through the strategic national stockpile allocations. The vaccine will go to hospitals and health departments and be distributed from there. Schippert said the vaccine will only be distributed to 50 counties out of 103 counties in the state of Illinois. Notifications have not gone out about who will be receiving the vaccines but Schippert said they have been told Counties with the highest death rates will receive it. Voting is set to occur tomorrow, December 8th, on the priority list which potentially is as follows:

• 1st round: Hospitals and Health Departments

• 2nd round: Long term care facilities

• 3rd round: Emergency Service Personnel

• 4th round: Doctor’s Offices and clinics

• 5th round: Anyone 65 and older with a diagnosed medical condition that would compromise their immune system

• 6th round: Anyone 65 and older

• 7th round: General public

Schippert said the health department already has an emergency plan in place for the mass distribution of the vaccine. One of the plans is to request the use of the Administrative Center Parking lot as a drive-thru for administering the vaccinations.

Members present were Barbara Offill, Roger Bard, Kevin Coughenour, Ernie Curtis, Leanne Duby, Thomas Lynch and John Zumwalt. Also present County Board Chairman John Shure, Finance Manager Jill Johnson, ICPHD Administrator Dee Schippert, ICPHD Administrative Assistant Taylor Eades, EMA Director Eric Ceci and Animal Control Director Dr. Youssef.

The meeting was called to order.

It was moved by Roger Bard and seconded by Leanne Duby to approve the agenda. Motion carried by a voice vote.

The committee reviewed the claims. It was moved by Duby and seconded by John Zumwalt to pay the claims, subject to County Board approval. A roll call vote was taken. Motion carried.

Animal Control Director Dr. Youssef gave his report for November which included 2 dogs and 1 cat brought to the clinic. There have been no positive rabies cases.

ICPHD Administrator Dee Schippert distributed the summary report of programs. During the month of November, sanitation inspections were down. This is due to many places closing voluntarily. Schippert said she did not close any restaurants. She believes indoor dining establishments are doing everything they can to keep safe and she has the full support of the Board of Health. Schippert explained letters will be sent out encouraging closure but no further action will be taken. They have not been able to link any cases to indoor dining.

There were eight water samples in November. Immunizations are still being done by appointment. There were eight animal bites reported in November.

Schippert reported that as of yesterday there were 1,926 total cases that have tested positive for COVID-19 in Iroquois County. A press release was sent out yesterday stating the CDC guidelines for quarantine have changed. The quarantine period has always been 14 days. Now they are allowing health departments to have the option of ending quarantine at day 10. If individuals continue to have symptoms, they should continue to stay quarantined.

Schippert discussed the release of the vaccination. The first vaccine is being released by Pfizer and is an ultra-cold vaccine that has to be kept in a freezer that is -80 celsius. The vaccine can be kept on dry ice but once thawed has to be used within 5 days. Schippert said the health

department is prepared to set up a mass vaccination clinic within 24 hours. EMA Director Eric Ceci said the vaccine could arrive as early as a couple of weeks and it is rumored that Iroquois County will receive a supply of the vaccine. The health department has a plan in place for the vaccinations which will involve health care workers.

Ceci distributed data sheets displaying the number of confirmed cases and probable cases in Iroquois County.

The meeting was called to order.

The department heads gave their monthly reports:

• County Clerk Breein Suver reported the 2020 general election is complete and her office is preparing for the consolidated election. Filing dates for the consolidated election will be from December 14th through December 21st. School districts and Multi-Township Assessors will file in the County Clerk’s Office. Anyone running for any other unit of local government will need to file with their local Clerk. Suver said the County Clerk’s Office is also receiving levies from local taxing bodies until December 29th. Drainage levies were due November 30th in the Circuit Clerk’s Office. Lastly, Suver discussed the special session County Board meeting that was held on November 23rd for the media conversion project that would possibly be awarded through the CURES grant. Suver said it was decided not to move forward with the project. She received a call that several Clerks and Recorders were getting denied from the grant application. Suver contacted DCEO and they confirmed the application for reimbursement would be denied.

• County Treasurer Kurt Albers reported the final tax distribution has been distributed to all taxing bodies with the exception of four due to some compliance issues they haven’t met yet.

Finance Manager Jill Johnson distributed the 2020 Tax Levy worksheet. Johnson explained the low, mid, and high rates are based upon the EAV rate obtained by Supervisor of Assessments Bob Yergler. The low rate is set at $590,000,000. The mid-rate is set at $610,000,000. The high rate is set at $620,000,000. Johnson reviewed the levy requests that were submitted. Yergler said he recommends approving the high rate. It was moved by Coughenour and seconded by Offill to approve the FY20 Levy using the high rate. A roll call vote was taken. Zumwalt, aye; Coughenour, aye; Curtis, aye; Duby, aye; Offill, aye; Lynch, abstain; Bard, aye. Motion carried.

Yergler reported the Board of Review is working on complaints. The Assessment Office is working on the land use map.

County Clerk Breein Suver presented the committee with resolutions from the trustee for six additional parcels that were acquired through the delinquent tax process and that have been sold. Of the six parcels, three are going to the City of Watseka and one is going to the Village of Donovan. The total amount coming to the County is $4,422.50. It was moved by Offill and

seconded by Zumwalt to approve the six resolutions for the sale of property acquired through the delinquent tax process. A roll call vote was taken. Motion carried.

Devine explained they handle all of the County’s appeals. It was moved by Chad McGinnis and seconded by Ducat to approve the resolution to State’s Attorneys Appellate Prosecutor for $9,000. A roll call vote was taken. Motion carried.

The committee reviewed monthly reports for Probation and ETSB.

The committee reviewed the claims. Behrends informed the committee of a correction to a claim for Williams Communication for labor for new squad installation in the amount of $7,200. It was moved by Ducat and seconded by David Penny to pay the Judicial & Public Safety claims, subject to County Board approval. A roll call vote was taken. Motion carried.

RESOLUTION NO. R2020-77

STATE’S ATTORNEY APPELLATE PROSECUTOR

WHEREAS, the Office of the State’s Attorneys Appellate Prosecutor was created to provide services to State’s Attorneys in Judicial Districts containing less than 3,000,000 inhabitants; and

WHEREAS, the powers and duties of the Office of the State’s Attorneys Appellate Prosecutor are defined and enumerated in the “State’s Attorneys Appellate Prosecutor’s Act”, 725 ILCS 210/1 et seq., as amended; and

WHEREAS, the Illinois General Assembly appropriates monies for the ordinary and contingent expenses of the Office of the State’s Attorneys Appellate Prosecutor, one-third from the State’s Attorneys Appellate Prosecutor’s County Fund and two-thirds from the General Revenue Fund, provided that such funding receives approval and support from within the respective Counties eligible to apply; and

WHEREAS, the Office of the State’s Attorneys Appellate Prosecutor shall administer the operation of the appellate offices so as to insure that all participating State’s Attorneys continue to have final authority in preparation, filing, and arguing of all appellate briefs and any trial assistance; and

NOW, THEREFORE BE IT RESOLVED that the Iroquois County Board, in regular session, this 15th day of December, 2020 does hereby support the continued operation of the Office of the State’s Attorneys Appellate Prosecutor, and designates the Office of the State’s Attorneys Appellate Prosecutor as its Agent to administer the operation of the appellate offices and process said appellate court cased for this County.

BE IT FURTHER RESOLVED that the attorneys employed by the Office of the State’s Attorneys Appellate Prosecutor are hereby authorized to act as Assistant State’s Attorneys on behalf of the State’s Attorneys of this County in the appeal of all cases, when requested to do so by the State’s Attorney, and with the advice and consent of the State’s Attorney prepare, file, and argue appellate briefs for those cases; and also, as may be requested by the State’s Attorney, to assist in the prosecution of cases under the Illinois Controlled Substances Act, the Cannabis Control Act, the Drug Asset Forfeiture Procedure Act and the Narcotics Profit Forfeiture Act. Such attorneys are further authorized to assist the State’s Attorney in the trial and appeal of tax objections.

BE IT FURTHER RESOLVED that the Office of the State’s Attorneys Appellate Prosecutor will offer Continuing Legal Education training programs to the State’s Attorney and Assistant State’s Attorneys.

BE IT FURTHER RESOLVED that the attorneys employed by the Office of the State’s Attorneys Appellate Prosecutor may also assist the State’s Attorney of this County in the discharge of the State’s Attorney’s duties in the prosecution and trial of other cases, and may act as Special Prosecutor if duly appointed to do so by a court having jurisdiction.

BE IT FURTHER RESOLVED, that if the Office of the State’s Attorneys Appellate Prosecutor is duly appointed to act as a Special Prosecutor in this County by a court having jurisdiction, this County will provide reasonable and necessary clerical and administrative support and victim-witness coordination on an as-needed basis and will also cover all reasonable and necessary case expenses such as expert witness fees, transcripts, evidence presentation, documents, lodgings, and all other expenses directly related to the prosecution of the case.

BE IT FURTHER RESOLVED that the Iroquois County Board hereby agrees to participate in the service program of the Office of the State’s Attorneys Appellate Prosecutor, commencing December 1, 2020, and ending November 30, 2021, by hereby appropriating the sum of $9,000.00 as consideration for the express purpose of providing a portion of the funds required for financing the operation of the Office of the State’s Attorneys Appellate Prosecutor, and agrees to deliver the same to the Office of the State’s Attorneys Appellate Prosecutor on request during the stated twelve month period.

Mr. Young, member of the Finance Committee, gave the report of his committee. At this time, the Board began discussion about the contract for law enforcement services for the Gilman and Onarga areas. There was discussion regarding the hiring of two additional deputies and Sheriff Derek Hagen said he would not be in favor of moving forward with the contract if it did not come with the additional hires. Based on the current schedule and the fact that there is currently one deputy off on medical leave, the County would not be gaining anything as far as coverage of the areas outside of Gilman and Onarga if the additional deputies are not hired. The Board talked about funding the $21,000 portion of the agreement which would fall on the County. Many felt the Public Safety Fund would be the most reasonable source for the funding. After further discussion, it was moved by Ms. Duby and seconded to hire the two additional deputies contingent upon the signing of the contracts between the County, City of Gilman, and Village of Onarga in addition to the approval of the contract by the State’s Attorney; with the County’s portion of the deputies to come from the Public Safety Fund. Suzie Werner with HomeStar Insurance reported the annual benefits fair was held last month.

The department heads gave their monthly reports. They are as follows:

● Finance Manager Jill Johnson reported she is beginning to work on the FY20 audit and auditors will be onsite next week.

● Supervisor of Assessments Bob Yergler reported the Assessment Office is working on board of review complaints and the land use map.

● Treasurer Kurt Albers distributed the monthly Treasurer’s report.

● County Clerk Breein Suver reported it was decided not to move forward with the media conversion project for the Recording Office. After the November 23rd meeting, Suver said she was contacted by the vendor and was told that several other Recorder’s were denied by DCEO for the grant reimbursement. Rather than issuing a check and waiting for reimbursement, Suver reached out to DCEO and received confirmation that the grant would be denied.

● 911 Director Eric Raymond reported the ETSB Board met last night and are currently entertaining a request for proposal for public safety software. Raymond said the project is costly but there are parts that effect the Sheriff’s Department. The ETSB Board will be speaking with Sheriff Derek Hagen about the jail management system to see if he has any interest in the system. Raymond received a quote of $185,000 of which $60,000 would be the Sheriff’s portion. If Hagen decides to stay with the current system, which is intertwined with the present 911 system, the connection will be broken. Raymond said the recommendation was tabled at the meeting until further discussions could be held with Hagen. The cost would come from the ETSB budget. Also, a new employee was hired on November 21st and is in training.

County Board Chairman John Shure prepared a draft Contract for Law Enforcement Services for the City of Gilman and the Village of Onarga. During the November meeting, Hagen distributed information to the Board regarding this matter which has been an ongoing discussion since August of last year. Shure and the committee read through the contract. Shure noted the contract has not been reviewed by State’s Attorney Jim Devine yet. After reviewing the contract, Shure discussed the hiring of deputies. Shure said it had been agreed that the deputies Hagen hired last year would be assigned to this contract but they have since been assigned other duties and Hagen is talking about hiring two additional deputies. McTaggart recalled a discussion during budget hearings about the deputies being included in the budget twice, once in the General Fund and again in Public Safety. The deputies were removed from the Public Safety budget at that time. Shure also added that Hagen has discussed the hiring of additional deputies while meeting with the City of Gilman. Shure said the matter of the deputies needs to be resolved but it is separate from the contract. Paul Bowers verified with Shure that either party can void the contract. Johnson suggested approaching Hagen about assigning deputies that are already employed to avoid the risk of hiring someone new and potentially losing them once the contract is expired. Also, Johnson mentioned a possible union issue due to the job not being offered to current employees first. The committee continued to review the contract and made changes to the costs of benefits, hourly rate of pay and termination days. It was moved by McTaggart and seconded by Johnson to send the Contract for Law Enforcement Services to the full County Board with the preliminary adjustments consisting of the addition of health insurance costs in paragraph two, $60 per hour rate of pay in paragraph four and a termination notice of 60 days in paragraph twelve. Motion carried by a voice vote.

The committee reviewed the claims. It was moved by Johnson and seconded by Bowers to pay the claims subject to County Board approval. A roll call vote was taken. Motion carried. There was no old business.

During new business, Johnson informed McTaggart of the insurance presentation that was held last month and suggested the company be added to the list of providers we contact during renewal time.

Finance Manager Jill Johnson gave an update on the website rebuild. Johnson has been in contact with Webfoot Designs. They have a preliminary list they are working on. Also, an email was sent to department heads requesting their needs or wants for the new website. Johnson expects the new website to be live by February 2021.

Michael Taber with AreaWide reported the ICN connection is online and enabled. A technician is scheduling time with users to test the connection. Taber said the County will have a dual connection until the AT&T contract expires.

Taber reported AreaWide has been assisting the health department with numerous items such as workstations and new equipment for contact tracing. They have also purchased a new switch due to the expansion of the department. Johnson noted the health department is paying for the additional labor and the cost of the switch from grant funds.

The Abila server is scheduled for replacement in 2021 and the CAD server is still in the planning phase. The Highway Department has seven computers that are running on Windows 7 scheduled for replacement in 2021.

Taber said the County Clerk & Recorder’s Office required some assistance with questions in regards to the 2021 HAVA grant. Suver said the grant is approximately $19,000 and the email security training has been paid from this grant. Other items, such as a portion of the website redesign, can be paid from the grant funds as long as it is related to the election.

Last month, Taber discussed password changes but hasn’t moved forward with the implementation.

Shure reported the County Clerk & Recorder’s Office didn’t move forward with the media conversion project that was to be funded by the CURES grant. Shure stressed the project should be taken very seriously and other measures need to be taken to make sure the project is completed. County Clerk Breein Suver said the approximate $80,000 proposal was for a 10 year span and this was for integrating documents into the recording system and having them numbered. Another option, which would solve our immediate need and be less costly, would be to have the scanning done without the integration and numbering done but the documents would still be digitized. This proposal was estimated at $11,000. The documents would be scanned and put on a hard drive. Suver will reach out to the current vendor and the vendor used by the Circuit Clerk’s Office for more information.

County Engineer Joel Moore reported tentative year end revenue and expense total percentages as follows:

• Highway revenue ended at 1.8% under the projected amount budgeted and expenses were 4.5% under the amount budgeted.

• County Bridge revenue ended at 3.8% over the projected amount budgeted and expenses were 19% over the amount budgeted.

• Matching Tax revenue ended at 3.5% over the projected amount budgeted and expenses were 9.3% over the amount budgeted.

• County Motor Fuel Tax ended at 45% over the projected amount budgeted and expenses were 17.6% under the amount budgeted.

• Township Motor Fuel Tax ended at 36.9% over the projected amount budgeted and expenses were 5.5% under the amount budgeted.

Final revenue and expense numbers will be available at the January Highway meeting. Moore presented the annual resolution for maintenance. The letting will be held on January 27th at 9:00 A.M. and is tentatively scheduled to be held in the maintenance garage. Moore has $1,150,000 budgeted for the maintenance resolution. This includes maintenance salaries, equipment rental and all other general maintenance. It was moved by Zumwalt and seconded by Chad McGinnis to approve the resolution for maintenance expenditures for Motor Fuel Tax. A roll call vote was taken. Motion carried.

Moore also presented a resolution appropriating funds for the County Engineer’s salary. Moore’s salary is 95% of the IDOT recommended salary. The recommended increase for FY21 is 1.5% with a re-ranking. Iroquois County is ranked 34 out of 102. Moore’s annual salary for FY21 will be set at $112,575. It was moved by Johnson and seconded by Donna Crow to approve the County Engineer’s salary resolution. A roll call vote was taken. Motion carried.

There was no new business.

During old business, Moore spoke about the Woodland Bridge agreement that was discussed at a prior meeting. The agreement states 20% is to be paid from Major Bridge Funds. The amount the state is responsible for was based off the estimate but the bids came in a lot higher than expected. Moore said he is expected to pay the additional $300,000 rather than revising the federal agreement. Moore does not plan to pay the additional money and will keep the committee updated.
