Here are the minutes provided by the board:

1. CALL TO ORDER

Meeting called to order at 5:30 PM by Village Attorney Patrick Dunn

Procedural: A. Pledge of Allegiance - led by Attorney Patrick Dunn

Procedural: B. Roll Call - Village Clerk Brian Simeur

Members present: Trustee Bruce Greenlee, Trustee Rick Fischer, Trustee Randy King, Trustee Jack Littrell, and Trustee Angie Serafini. Also in attendance, Treasurer Ron Riebe, Attorney Patrick Dunn, Administrator Mike Van Mill. Absent: Mayor Paul Schore and Trustee Jeff Keast

> Attorney Dunn requested Trustees to appoint Trustee Rick Fischer as the Temporary Chairman since Village President Paul Schore is absent

Motion by Trustee Bruce Greenlee, second by Trustee Jack Littrell appointing Trustee Rick Fischer as Temporary Chairman for tonight's Regular Board Meeting.

2. APPROVAL OF MINUTES

Action, Minutes: A. Regular Board Meeting Minutes from October 3, 2022

Motion by Trustee Jack Littrell, second by Trustee Angie Serafini to approve the Regular Board Meeting Minutes from October 3, 2022, as presented.

3. REPORTS FROM COMMISSIONS AND ADVISORY BOARDS

Action, Reports: A. Planning Commission PA22-0001 - Annexation of 390 N. Convent Street Report

> Assistant Administrator Laurie Cyr stated the applicant Village of Bourbonnais on behalf of Richard Bateman requested to annex 390 N. Convent Street with a B-1 Commercial Business zoning (on Board Docs). The current use is for an accounting, tax preparation, bookkeeping and payroll office which is a permitted use. After deliberation of the testimony presented, the Planning Commission voted 5-0 approving the annexation with a B-1 Central Commercial Business Zoning district .

Motion by Trustee Jack Littrell, second by Trustee Angie Serafini to accept the Planning Commission's finding's report and take it under advisement.

Action, Reports: B. Planning Commission PA22-0003 - Annexation of 610 Armour Road Report

> Ms. Cyr stated the applicant Village of Bourbonnais on behalf of Mary Ann Leveque requested to annex 610 Armour Road with a R-1 One-Family Residence zoning (on Board Docs). The current use is a single family dwelling which is a permitted use. Mrs. Leveque's son attended the meeting via Zoom. After deliberation of the testimony presented, the Planning Commission voted 5-0 approving the annexation of 610 Armour Road with a R-1 zoning.

Motion by Trustee Bruce Greenlee, second by Trustee Angie Serafini to accept the Planning Commission's finding's report and take it under advisement.

Action, Reports: C. Planning Commission PA22-0008 - Annexation of 811 Larry Power Road Report

> Ms. Cyr stated the applicant 811 Larry Power Road LLC requested to annex 811 Larry Power Road with a B-2 Corridor Commercial Business zoning (on Board Docs). Attorney Ken Carlson presented the case, there was no opposition to the annexation of this property. After deliberation of the testimony presented, the Planning Commission voted 5-0 approving the annexation of 811 Larry Power Road with a B-2 zoning.

Motion by Trustee Jack Littrell, second by Trustee Randy King to accept the Planning Commission's finding's report and take it under advisement.

Action, Reports: D. Planning Commission PR22-0003 - IM Steel Report

> Ms. Cyr stated the applicant IM Steel is requesting consideration of rezoning the proposed development site from B-1 to M-2 General Manufacturing (on Board Docs). The site covers 4.5 acres and they are asking to allow an office building, solid waste collection, remediation, and other waste management services. Attorney Ken Carlson and Kevin Kennel represented the applicant. There were attendees at the meeting regarding this case. After the presentation by the applicant, the Planning Commission listed their findings of facts which are included in this case report. After deliberation of the information presented, the Planning Commission voted 5-0 approving the rezoning of IM Steel from B-1 Central Commercial Business to M-2 General Manufacturing.

Motion by Trustee Randy King, second by Trustee Angie Serafini to accept the Planning Commission's finding's report and take it under advisement.

Action, Reports: E. Planning Commission PSU22-0004 - IM Steel Report

> Ms. Cyr stated the applicant IM Steel is requesting a special use to allow solid waste collection, remediation, and other waste management services in an M-2 General Manufacturing district (on Board Docs), this site covers 30 acres. Attorney Ken Carlson and Kevin Kennel presented that the special use is to operate a collection and recycling center, scrap processing center, steel distribution, sales facility, and outdoor storage the applicant. There were attendees at the meeting regarding this case. After the presentation by the applicant, the Planning Commission listed their findings of facts which are included in this case report. After deliberation of the information presented, the Planning Commission voted 4-1 to deny the special use of IM Steel from B-1 Central Commercial Business to M-2 General Manufacturing.

Motion by Trustee Angie Serafini, second by Trustee Randy King to accept the Planning Commission's finding's report and take it under advisement.

Action, Reports: F. Planning Commission PA22-0009 - Amend Chapter 36 - Zoning Use Table

> Ms. Cyr stated the applicant Village of Bourbonnais staff is requesting consideration of an Ordinance text amendment to Chapter 36, Section 10-6 regarding updating the Zoning Use Table (on Board Docs). Staff reviewed the NAIC codes which is a national classification of different land uses for deciding what is permitted, special uses, or not permitted in the Village. This is the process for us to update that table and meet those new zoning uses we want to adopt for the Village. Examples of changes would include used car lots would be a special use, video poker is a special use, and private storage would be a special use in B-2 along with M zoning. It allows for more flexibility on how defined the industry is getting to be able to classify businesses as they are coming into the Village. Mr. Van Mill stated it is important to continually monitor our development regulations in order to ensure that we are updated as much as possible, and doing this does help our ability to administer our Zoning Ordinance. After deliberation of the testimony presented, the Planning Commission voted 5-0 to approve the updating of the Zoning Use Table.

> Following the second reading by Clerk Simeur, Finance Director Tar Latz gave an overview on said Ordinance. This is to open an account with the Community Foundation, to accept donations from residents, businesses or others, and funds would be used in the future for things where we see a need towards anything we have going on in the Village, such as the Community Campus, a park project, or anything else. The Community Foundation will hold the funds for us and disburse them at our request so we can pay for items related to projects.

Motion by Trustee Rick Fischer, second by Trustee Randy King to adopt Ordinance 22-2357.

Action, Ordinance: C. ORDINANCE NO. 22–2358 - An Ordinance Establishing Salaries and Compensation for Trustees (SECOND READING)

Motion by Trustee Rick Fischer, second by Trustee Bruce Greenlee to read Ordinance 22-2358 by title only.

> Following the second reading by Clerk Simeur, Attorney Dunn gave an overview on said Ordinance. This Ordinance will allow $100 per Committee meeting payment to be made to Trustees who attend with a maximum total amount of $4,000 per year (cap). The last time salaries were adjusted was by Ordinance 88-676 which passed on August 18, 1988, that is the last time there has been any kind of change in Trustee services. It will apply first to the three Trustees who are running for election in April 2023, after they are elected and take their Oath this will go into effect. It will be available to the other three Trustees who are elected in 2025.

Motion by Trustee Rick Fischer, second by Trustee Jack Littrell to adopt Ordinance 22-2358.

7. ADMINISTRATION COMMITTEE - Trustee Angie Serafini, Chair

Action, Ordinance: A. ORDINANCE NO. 22–2359 - An Ordinance Declaring Police Department Items as Surplus and Authorizing its Disposal in the Village of Bourbonnais, Kankakee County, Illinois (FIRST READING) 

> Following the first reading by Clerk Simeur, Deputy Chief Dave Anderson explained this is for the 4 items of furniture that were stored in the basement of the Police Station that they would like to dispose of while doing the renovation for the investigator's office.

Action, Ordinance: B. RESOLUTION NO. 22–1498 - A Resolution Stating the Intent of the Village Board Concerning Use of Possible Increased Sales Tax for Property Tax Relief

Motion by Trustee Angie Serafini, second by Trustee Jack Littrell to read Resolution 22-1498 by title only.

> Following the first reading by Clerk Simeur, Mr. Van Mill gave an overview on said Resolution. It is associated with the Village's referendum that is on the November 8 ballot. The referendum is to add one cent sales tax in the Village. Established to reinforce the Village's commitment and priority that the funds generated will be used to rebate property taxes to owner occupied single family homeowners.

> Trustee King, Trustee Littrell, Trustee Serafini, Trustee Greenlee, and Trustee Fischer each stated their reasons for supporting this referendum and what it can do for the homeowners in the Village financially.

Motion by Trustee Angie Serafini, second by Trustee Jack Littrell to adopt Resolution 22-1498.

> Trustee Serafini stated Halloween Trick or Treat Hours on Monday, October 31 are from 5:00-7:00 PM.

> Trustee Serafini announced Court Street Ford will be hosting a Trunk or Treat on Friday, October 28 from 5:00-7:00 PM.

8. COMMUNITY & ECONOMIC DEVELOPMENT COMMITTEE - Trustee Jeff Keast, Chair - Absent - Trustee Angie Serafini filled in

Action, Resolution: A. RESOLUTION NO. 22–1496 - A Resolution Approving and Authorizing a Business Assistance Grant to AEK Interiors, Inc.

Motion by Trustee Angie Serafini, second by Trustee Jack Littrell to read Resolution 22-1496 by title only.

> Following the first reading by Clerk Simeur, Mr. Van Mill gave an overview on said Resolution. It is an economic incentive to Swanky Homes which recently moved into the Village next to Chicago Dough Pizza. This was discussed at the last Community & Economic Development Committee meeting. Swanky Homes experienced some unexpected costs as a result of our building code Ordinance in regard to signage. The Board agreed we would assist them with $1,000 economic incentive to cover part of the additional work that had to be done to bring them into compliance with our new signage regulations.

Motion by Trustee Angie Serafini, second by Trustee Randy King to adopt Resolution 22-1496.

9. POLICE COMMITTEE - Trustee Bruce Greenlee, Chair

> Deputy Chief Anderson announced upcoming Community Town Hall meetings will be held on October 19 from 5:30-6:30 Area 1 and 7:00-8:00 PM Area 2, and again on October 26 at 5:30-6:30 Area 3 and 7:00-8:00 PM Area 4 based on their brush pick up schedule. Residents will be able to meet Police Administration Staff and Patrol Officers, they will be able to interact with us and state their concerns, if we find we need to have to do a follow-up meeting, it will be arranged. Meetings will be held in the Community Room, an article was posted in the Daily Journal last week.

10. PUBLIC WORKS COMMITTEE - Trustee Randy King, Chair

Trustee King read a report from Interim Public Works Director Dave Herberger, giving the following updates:

> Continue to have issues with residents blowing their grass and leaves into the streets and clogging the drainage tiles.

> Street sweepers are out trying to clear streets, garbage cans should be up on the curbs please.

> Brush pick up this week is Area 4, a schedule is available on the Village website, at the Admin building, or Public Works office. Reminder do not put your brush out sooner than the day before pick up and do not put brush in the street.

> Plow trucks are being serviced for the snow season.

> First round of interviews for a new Operator have been completed.

> Work continues at Stonemill Park site, new rocks are finished also for Patriot Park, waiting for delivery.

> Damage and graffiti in our Village parks has decreased some since school is back in session. Reminder, it is a criminal offense - please report to the Police if anyone sees anything occur, you can remain anonymous.

> Continue to repair streets and storm drains.

> Ms. Cyr gave an update on the Log School House - construction has begun and is moving along, walls are up, roof is on, and windows are framed. Inauguration will be held November 15 at 2:00 PM at the property. The Historical Society dinner will be held that evening at 5:30 PM. Information and ticket purchase can be found on the bourbonnaishistory.org website.
