1. CALL TO ORDER

Meeting called to order at 5:30 PM by Village President Paul Schore

Procedural: A. Pledge of Allegiance - Led by 4th grade student Charlee Skeate from Liberty Intermediate School.

Procedural: B. Roll Call - Village Clerk Brian Simeur

Members present: Mayor Paul Schore, Trustee Bruce Greenlee, Trustee Rick Fischer (via Zoom), Trustee Randy King, Trustee Jeff Keast, Trustee Jack Littrell, and Trustee Angie Serafini. Also in attendance, Treasurer Ron Riebe, Attorney Patrick Dunn, and Administrator Mike Van Mill

2. APPROVAL OF MINUTES

Action, Minutes: A. Regular Board Meeting Minutes from October 17, 2022

Motion by Trustee Jeff Keast, second by Trustee Jack Littrell to approve the Regular Board Meeting Minutes from October 17, 2022, as presented.

4. BIDS AND QUOTES

Action, Bids: A. Bids & Quotes - Goselin Park & Village Green

> Ms. Cyr stated on October 7, 2022 we received and opened two bids for the Goselin Park & Village Green project located on the Village campus (on Board Docs). The first bid opened was from Johnson-Downs Construction which included the three alternates put into the bid, the total bid was $18,519,285. The second bid was from Piggush-Simoneau, Inc. including all of their alternates, the total bid was $19,472,793. After review of the bids and supporting documents, we recommend approving the Goselin Park & Village Green project to Johnson-Downs Construction.

Motion by Trustee Jeff Keast, second by Trustee Jack Littrell to approve and accept the lowest bid from Johnson Downs Construction Company, Inc. in the amount of $18,519,285, and award the project.

Action, Accounts Payable: A. Finance Committee - Consideration of the November 7, 2022 Accounts Payable

Motion by Trustee Rick Fischer, second by Trustee Bruce Greenlee to approve payment of the general and special fund bill list, as presented.

Action, Ordinance: B. ORDINANCE NO. 22–2361 - An Ordinance Authorizing and Approving an Amended Redevelopment Agreement between Jennings Realty, Inc., Barbara Descendants Trust, and the Village of Bourbonnais, Kankakee County, Illinois (FIRST READING)

> Following the first reading by Clerk Simeur, Administrator Van Mill gave a summary of this Amended Redevelopment Agreement with Jennings Realty to financially assist with the extension of water, sewer, and the construction of a road (Quebec Drive) at the property located on the southside of Bourbonnais Parkway and west of the interchange. The infrastructure improvements will result in the construction of the Road Ranger Travel Center and create at least 3 developable lots to provide balance in the acreage for future development. A financial incentive prorated schedule amendment to the agreement is outlined in this Ordinance (on Board Docs).

Action, Ordinance: C. ORDINANCE NO. 22–2363 - An Ordinance Authorizing Abatement of the Tax Levy for the $4,715,000 General Obligation Bonds (Sales Tax Alternate Revenue Source), Series 2020, of the Village of Bourbonnais, Kankakee County, Illinois for the 2022 Tax Levy Year (FIRST READING)

Action, Ordinance: D. ORDINANCE NO. 22–2364 - An Ordinance Authorizing Abatement of the Tax Levy for the $1,460,000 General Obligation Bonds (Alternate Revenue Source), Series 2021A, of the Village of Bourbonnais, Kankakee County, Illinois for the 2022 Tax Levy Year (FIRST READING)

Action, Ordinance: E. ORDINANCE NO. 22–2365 - An Ordinance Authorizing Abatement of the Tax Levy for the $2,395,000 Taxable General Obligation Refunding Bonds (Alternate Revenue Source), Series 2021B, of the Village of Bourbonnais, Kankakee County, Illinois for the 2022 Tax Levy Year (FIRST READING)

Action, Ordinance: F. ORDINANCE NO. 22–2366 - An Ordinance Authorizing Abatement of the Tax Levy for the $19,945,000 General Obligation Bonds (Alternate Revenue Source), Series 2022, of the Village of Bourbonnais, Kankakee County, Illinois for the 2022 Tax Levy Year (FIRST READING)

> Following the first readings by Clerk Simeur, Finance Director Tara Latz gave an overview of all four Ordinances in regard to bond abatement of the tax levy for the four outstanding bond issuances. These will abate the principal and interest payments for the coming year from our 2022 tax levy requests. They will exclude the coming year's bond payments from the monies we will be collecting on the Village portion tax bills for property within the Bourbonnais Corporate Limits. By doing this, the Village is saving taxpayers anywhere from $188 to $566 depending on the value of their home.

Action, Resolution: G. RESOLUTION NO. 22–1502 - A Resolution Approving Release of Retainage for the Joint Storm Water Project on Burns Road

> Following the first reading by Clerk Simeur, Mrs. Latz gave an overview on said Resolution. In 2020, the Village entered into an agreement to help pay for storm water improvements for the new Riverside Orthopedic facility at the corner of Route 45 and Burns Road. One remaining payment left of $104,000 the Village was holding as retainage until the final punch list items were completed. Now that those items are fully completed, the Village will be releasing the final retainage to Riverside with the passage of this Resolution.

Motion by Trustee Rick Fischer, second by Trustee Jeff Keast to adopt Ordinance 22-1502.

Action, Ordinance: A. ORDINANCE NO. 22–2359 - An Ordinance Declaring Police Department Items as Surplus and Authorizing its Disposal in the Village of Bourbonnais, Kankakee County, Illinois (SECOND READING)

> Following the first reading by Clerk Simeur, Ms. Cyr gave an overview on said Ordinance, stating the Police Department is remodeling the old finance office to become the new investigations department area and there is old inventoried furniture that needs to be disposed of.

Action, Ordinance: B. ORDINANCE NO. 22–2360 - An Ordinance Declaring Police and Public Works Department Computers Surplus and Authorizing its Disposal in the Village of Bourbonnais, Kankakee County, Illinois (FIRST READING)

> Following the first reading by Clerk Simeur, Ms. Cyr stated it's the same as above.

> Trustee Serafini announced the Salvation Army Coat Drive has started and runs until December 2, 2022. Bins are located at the Village Admin building and Police Department foyer for drop off of coats, hats, gloves, scarves, socks and long johns.

> Trustee Serafini reminded residents to please go out and vote tomorrow.

8. COMMUNITY & ECONOMIC DEVELOPMENT COMMITTEE - Trustee Jeff Keast, Chair

Action, Resolution: A. RESOLUTION NO. 22–1499 - A Resolution Approving an Intergovernmental Agreement between the Village of Bourbonnais and the County of Kankakee for the Purpose of Implementing a Historic Preservation for the Bourbonnais Grove School

Motion by Trustee Jeff Keast, second by Trustee Randy King to read Resolution 22-1499.

> Following the first reading by Clerk Simeur, Mr. Van Mill stated the County's Historical Preservation Board came to the Village and requested that the Grove School House be designated a historical structure and this Resolution is the first step into making sure that it happens.

> Mayor Schore introduced Dr. James Paul from the Historical Society who gave an overview of the historical structure. The Log House School is being rebuilt originally from 1837, which was a pivotal year in this area when the Potawatomie Indians left the area, and the French Canadians moved in and needed a school. On November 15, 2022, we are having the inauguration and dedication of Grove School house at 2:00 PM at the location 698 Stratford Drive, Bourbonnais.

Action, Ordinance: B. ORDINANCE NO. 22–2362 - An Ordinance Repealing the Current Chapter 36 Zoning District Use Table of the Municipal Code and Replacing it with the New Chapter 36 Zoning District Use Table as Attached (FIRST READING)

> Following the first reading by Clerk Simeur, Ms. Cyr stated we had a Public Hearing at the Planning Commission to amend the Use Table for various zoning classifications in the Village to be up-to-date with the NCIS codes, this is the Ordinance allowing us to amend that Table.

Action, Ordinance: C. ORDINANCE NO. 22–2367 - An Ordinance Amending the Zoning Classification of Real Property Owned by IM Steel on Larry Power Road (FIRST READING)

> Following the first reading by Clerk Simeur, Ms. Cyr explained at the last Planning Commission meeting we had a Public Hearing requesting to rezone from B-2 to M-1 the 4-acre property that IM Steel owns on Larry Power Road west of the railroad.

Trustee Keast gave a report from the building department:

> As of October 2022, new single family home permits are half of what it was last year. The valuation of the other permits is higher than last year.

9. POLICE COMMITTEE - Trustee Bruce Greenlee, Chair

> Trustee Greenlee asked Sergeant Kendregan to give an explanation about the upcoming high intensity rapid deployment training on November 8 and November 21 at BBCHS, which includes all area police departments.

10. PUBLIC WORKS COMMITTEE - Trustee Randy King, Chair

Action, Resolution: A. RESOLUTION NO. 22–1500 - A Resolution for Maintenance of Streets and Highways by Municipality Under the Illinois Highway Code Using Rebuild Illinois Funds for 5000N Road Construction

Motion by Trustee Randy King, second by Trustee Jeff Keast to read Resolution 22-1500 by title only.

> Following the first reading by Clerk Simeur, Ms. Cyr explained this will be the reconstruction of 5000 N Road from Route 45 to Career Center Road, currently it is an A-1 tar and chip surface, it's going to be removed and replaced with two lifts of permanent asphalt to make it an arterial road.

Motion by Trustee Randy King, second by Trustee Jack Littrell to adopt Resolution 22-1500.

> Following the first reading by Clerk Simeur, Ms. Cyr explained this will be the same process as above, except from Bourbonnais Parkway to Route 45 to 1/2 mile west of Career Center Road where our corporate limits end.

Trustee King read a report from Public Works Interim Director Dave Herberger, giving the following updates:

> The Village continues to have issues with residents blowing their grass and leaves into the streets and clogging the drainage tiles and causes flooding.

> Street sweepers are out trying to clear streets.

> Brush pick up this week is in Area 3, a schedule is available on the Village website, at the Admin building, or Public Works office.

> Area 4 will be on November 16 and will be the final pickup for brush this year. Public Works will go through the Village one more time that week only to pick up any other brush for the final time until next season.

> Plow trucks are being serviced for the snow season.

> Mowers have been cleaned and put away for the winter.

> First salt delivery is scheduled for next week.

> Work continues at the Stonemill Park site, the shelter was delivered last week. New identification rocks for Stonemill Park and Patriot Park are installed.

> Finished repairing streets and storm drains.

Information: A. Mayor Updates

> Reminder tomorrow is election day, and poles are open from 6:00 AM to 7:00 PM.

> Village referendum question is on the ballot asking for a 1% sales tax increase, it would offer residents annual property tax rebates for single-family owner-occupied homeowners in the Village on the municipal portion of their tax bill for at least 10 years. Call the Admin building with any questions.

> Thank you to all those who volunteered for the Court Street Ford Trunk or Treat event on Friday, October 28, 2022, it was a good turnout.

> Village offices will be closed on Veteran's Day, Friday, November 11, 2022.

> Resident David Sadler asked for support from the Village to help fund the turf baseball fields at Diamond Point Park. He provided information on other communities that have turf fields and what it does economically for their area.

Motion to Enter into Executive Session to discuss the minutes of meetings lawfully closed under the Illinois Open Meetings Act, whether for purposes of approval of the body of the minutes or semi-annual review of the minutes pursuant to Section 2.06 of the Act as allowed by 5 ILCS 120/2 (c)(21).
