Village of Bourbonnais Board of Trustees met Aug. 19.

Here are the minutes provided by the board:

1. CALL TO ORDER

Meeting called to order at 5:30 PM by Village President Paul Schore

Procedural: A. Pledge of Allegiance

Members present: Mayor Paul Schore, Trustee Bruce Greenlee, Trustee Rick Fischer, Trustee Randy King, Trustee Jeff Keast, and Trustee Jack Littrell. Also in attendance, Treasurer Ron Riebe, Attorney Patrick Dunn and Administrator Michael Van Mill. Absent: Trustee Angie Serafini

2. APPROVAL OF MINUTES

Action, Minutes: A. Regular Board Meeting Minutes from August 5, 2024

Motion by Trustee Rick Fischer, second by Trustee Jeff Keast to approve the Regular Board Meeting Minutes from August 5, 2024, as presented.

Final Resolution: Motion Carried

Mayor Schore requested permission from the Board to move up Agenda Item 9. A. in the meeting.

> Chief Phelps recited the Oath of Office with the Village of Bourbonnais' new Patrol Sergeant Ignacio Czako.

Action, Accounts Payable: A. Finance Committee - Consideration of the August 19, 2024 Accounts Payable

Motion by Trustee Rick Fischer, second by Trustee Bruce Greenlee to approve the general and special fund bill list, as presented.

Final Resolution: Motion Carried

Action, Ordinance: B. ORDINANCE NO. 24-2463 - An Ordinance Approving and Authorizing the Execution of a Settlement Agreement and Mutual Release Between the Village of Bourbonnais, M&J Underground, Inc., and Nationwide Mutual Insurance Company Regarding Case Numbers 2019 L 157 and 2021 L 119 (SECOND READING)

Motion by Trustee Rick Fischer, second by Trustee Jeff Keast to read Ordinance 24-2463 by title only. Motion Carried

Following the second reading by Clerk Simeur, Attorney Dunn explained this Agreement will settle two lawsuits concerning the completion of the sewer project running the sewer line up to Bourbonnais Parkway. There was a dispute over how to complete that project between M&J and the Village of Bourbonnais. Thatresulted in the Village hiring another contractor who successfully completed the project as planned. M&J then sued the Village, and we had a countersuit against M&J. According to the agreement M&J Underground will have until March 1, 2025 to pay the Village $250,000 in full settlement of both lawsuits.

Motion by Trustee Rick Fischer, second by Trustee Randy King to adopt Ordinance 24-2463. Final Resolution: Motion Carried

7. ADMINISTRATION COMMITTEE - Trustee Angie Serafini, Chair - ABSENT

Information: A. Administration Committee

> In the absence of Trustee Serafini, Trustee Littrell announced upcoming events:

> Lunchtime Bites & Beats - will occur on Festival Street every Wednesday now through September from 11:00 AM to 1:00 PM, enjoy lunch from Food Trucks as well as live acoustic set from local performers.

> Movie on the Green - our next Dinner & Movie on the Green will be on Saturday, September 14 at The Grove. Food Trucks will be available for purchase starting at 6:00 PM and our featured film "If" will begin at 7:00 PM, don't forget your blankets and lawn chairs.

> Fridays @ 5 - our next event is this Friday, August 23 from 5:00 - 8:00 PM, enjoy live music from "Feel Good" and delicious food trucks outdoors.

8. COMMUNITY & ECONOMIC DEVELOPMENT COMMITTEE - Trustee Jeff Keast, Chair - None

9. POLICE COMMITTEE - Trustee Bruce Greenlee, Chair - Moved ahead in the meeting

> Trustee Greenlee thanked the Police Officers for their presence at last weekend's Food Truck Festival. Their Split the Pot booth raised $600 for Shop with a Cop program.

> Chief Phelps stated this evening we have the Annual Tip a Cop fundraiser event at Texas Roadhouse from 4:00-8:00 PM for Special Olympics.

> Chief Phelps stated we have officers assisting at the Democratic National Convention in Chicago.

> Thank you to everyone who attended our 4th Annual Food Truck Festival and the premier of The Grove. Thank you to the Food Truck Sponsors whose financial aid helped make this event free to the community. Thank you to everyone involved with the planning for this event and volunteering their time during the event and helping with the cleanup and tear down. We appreciate the help of our Public Works and our Police Departments who also had a huge hand in this event. Looking forward to next year!

> It is back to school time, so a quick reminder to use caution while driving and be aware of school speed zone limits, school crossing safety and bus stop arm violations.

> The next Regular Board meeting will be on Tuesday, September 3, 2024 at 5:30 PM due to the Labor Day holiday.
