Village of Bourbonnais Community & Economic Development Committee met May 14.

Here are the minutes provided by the committee:

1. Meeting Opening

Meeting called to order at 3:30 PM by Trustee Rick Fischer

Action, Procedural: A. Roll Call by Trustee Rick Fischer

Members present: Mayor Jeff Keast, Trustee Bruce Greenlee (arrived at 3:39), Trustee Rick Fischer, Trustee Randy King, and Trustee Angie Serafini. Also in attendance, Attorney Patrick Dunn, Administrator Michael Van Mill, Assistant Administrator Laurie Cyr, Finance Director Tara Latz, Police Commander Jason Sztuba, Public Works Superintendent Terry, Public Works Assistant Superintendent Frank Triveline, Engineer Mike Gingerich, Community Development Technician Tyler Goodrich, Assistant Finance Director Holly St. Germaine, and Deputy Clerk Margie Beach. Absent: Trustee Jack Littrell and Treasurer Ron Riebe.

2. Review & Approve Minutes

Action, Minutes: A. Community & Economic Development Committee Meeting Minutes from April 2, 2025

Motion by Trustee Angie Serafini, second by Trustee Randy King to approve the Community & Economic Development Committee minutes from April 2, 2025, as presented.

Final Resolution: Motion Carried

3. Planning Commission

Discussion: A.PSU25-002: Special Use at 375 Main St NW in a B-1 Central Commercial Business for the allowance of Child Care Services (NAIC Code 424410). Applicant: Lamiesha Phillips, doing business as "Be My Hope, Inc."

> Mrs. Goodrich stated at the April 29 Planning Commission meeting they discussed a Special Use application from Be My Hope LLC (on Board Docs). They are requesting a Special Use at 375 Main St NW for a Child Care Service provider. The current property is vacant (Family Video) and the lease will begin June 1, if they get approval for this Special Use request. The hours of operation are 6:30 AM to 6:00 PM Monday - Friday, and they are planning to hire 10-12 employees. This center will offer child care to children 2-6 years old who experience behavioral and developmental delays. They believe it could open in 6 months once the renovations are completed.

> After deliberation of the testimony presented, the Planning Commission voted 6-0 recommending approval of this Special Use request.

> Mr. Van Mill questioned the applicant Ms. Phillips on her background and experience running this type of facility. She stated she has 11 years of health care experience working with children and the elderly at the University of Chicago, Rush and Edwards hospitals. The referrals to use this facility come from their website, and word of mouth, and already have a waiting list because they accept children with autism. Workers will have to have specified certification in order to care for the children. They will apply for a license from the State once the facility is ready for inspection by DCFS who will then tell them how many children they can allow in the building.

Community & Economic Development Committee concurs with the Planning Commission's recommendation, and legislation will be created for the next Regular Board meeting on May 19, 2025.

4. New Business

Discussion: A. Discussion regarding Restriction of ATV or Utility Terrain Vehicles > Mr. Van Mill stated this is a situation that has come to light the last couple months with very loud dirt bikes and ATV's running on and near private property and through the parks as well and is becoming a disturbance and nuisance. Nearby property owners have expressed their concerns and have called the Police several times with complaints. Attorney Dunn, Interim Chief Anderson, Ms. Cyr and he discussed how to deal with this circumstance with our current Codes which do not address this type of disturbance.

> Attorney Dunn explained he has drafted a proposal to amend an existing Ordinance Section 22-3 Bourbonnais Code of Ordinance which concerns disorderly conduct. It currently does not specifically address loud or unnecessary noises. Attorney Dunn is suggesting to create a sub section for that and it would address disturbances and distance from the use of all-terrain (ATV) vehicles, off-highway motorcycles, and recreational off-highway vehicles - these are defined by the Illinois Vehicle Code. > If an Ordinance is created and the distance is stated, the violation can be enforced by the Police because they can see and hear the off-road vehicle and can measure how far away they are from private properties and homes. He suggested a distance of a 100 feet from a property, and still would need approval for the amount of the fine.

> A Resident from River Place subdivision addressed the Board regarding ATV's that are currently running 10 feet from his property at all hours and the noise and dust is a huge concern. He quoted documentation from an Ordinance from the City of Marseilles that the Village could refer to regarding distance, decibel measurements, times of operations, etc.

Community & Economic Development Committee agrees to create this amendment to an existing Ordinance adding the distance and fine amounts, and it would be approved at an upcoming Regular Board meeting.
