a. A public hearing for the 1/1/2025-12/31/2025 Appropriations Ordinance for the Village of Westmont

Board to conduct a public hearing for the 1/1/2025 - 12/31/2025 Fiscal Year Appropriation Ordinance.

Background of Subject Matter

In accordance with state statute, the Village must adopt an appropriation ordinance during the first quarter of the fiscal year. The appropriation ordinance is the legal limit of the maximum amount that can be spent if sufficient funds are available.

Additional Background

The appropriation ordinance should exceed the expected amount to be spent. The budget is the financial plan of what the Village intends to spend; this appropriation ordinance is the legal limit that can possibly be spent if changes are necessary.

c. Award of Bid Proposal - Washington and Traube Infrastructure Improvements

Board to consider an ordinance awarding the bid to Performance Construction & Engineering LLC for the Washington and Traube Infrastructure Improvements project in the amount of $6,568,713.00 and authorizing a construction contract consistent with the bid documents.

Background of Subject Matter

The Village accepted bids from three contractors for the project. The low bidder was Performance Construction & Engineering LLC with a low bid of $6,568,713.00. The low bid is approximately 0.75% higher than the Engineer's Estimate of $6,519,727.00.

Additional Background

This project includes watermain replacement on Washington St from Naperville Rd to Ogden Av, storm sewer installation on Traube Av and Grant St, combination curb and gutter, sidewalk, asphalt paving, thermoplastic pavement marking and landscape restoration.

d. Non-Home Rule Municipal Occupational Tax and a Non-Home Rule Municipal Service Tax

Board to consider an ordinance imposing an additional Non-Home Rule Municipal Occupational Tax and a Non-Home Rule Municipal Service Tax.

Background of Subject Matter

Each additional tax in the amount of 1/2% is to be added to the Village's existing 1/2% tax for a combined total of 1%.

The proceeds of the tax shall be used for municipal operations, public

infrastructure, property tax relief, or any other purpose specifically allowed by state statute.

e. Reapproval of Amended Tree Regulations

Board to consider an ordinance reapproving comprehensive text amendments to Chapter 80 and Chapter 86 of the Westmont Code of Ordinances regarding trees and landscaping.

Background of Subject Matter

On 1/25/24, the Village Board approved comprehensive text amendments to Chapter 80 and 86 of the Village Code pertaining to tree regulations and landscaping requirements. The amendments were drafted by Interim Community Development Director Doug Pollock, with input from Village Forester Jon Yeater. However, the Village Attorney had difficulty placing these amendments into ordinance form due to formatting errors, tracking errors, word usage issues, and related issues.

Additional Background

These issues have been resolved, and these amendments are now being presented to the Board again for re-approval. The only substantive changes to the version approved on 1/25/24 involved the penalty provisions, which have now been revised to comply with legal requirements. The other changes are ministerial formatting and word usage changes.
