The Iroquois County Board met in Recessed Session on Tuesday, May 12, 2020 at 9 A.M. The meeting was conducted electronically, via conference call, under the Governor Executive Orders 20-7 and 20-18. The orders were issued in response to the COVID-19 pandemic, they require social distancing measures to be taken to stop the spread of the highly contagious virus. The orders also suspend certain provisions of the Illinois Open Meetings Act to allow for public bodies to continue their course of business during the public health emergency. Chairman Shure called the meeting to order and asked County Clerk Lisa Fancher to call the roll.

PUBLIC COMMENTS

Ryan Mustered of Watseka spoke to the Board regarding the opening of Iroquois County in regard to the COVID crisis. He said he was thankful for precautions that were taken and social distancing; however, limited social interaction takes a toll spiritually and emotionally on people. He was strongly in favor of a solid plan to open.

Tom Pierce of Crescent City told the Board that he feels the government is not basing their decisions on real time data and he feels the County needs to open things slowly, but not too slowly in order to get the economy back. He felt there is a way to get this done responsibly without causing mass hysteria as people need to build up an immunity to this virus.

FY2019 AUDIT

Hope Wheeler from Clifton Larson Allen, the company hired to perform the County’s audit, went over the FY2019 audit. She said they performed the audit using a risk-based approach focusing on internal controls, cash and investments, receivables and revenues, pension liability, and financial close and reporting. Total assets were $73 million opposed to $75 million last year, with liabilities of $8.5 million for the year leaving $65 million in net assets including $47 million in capital assets. She went over the Internal Control Communication Letter which listed material weaknesses and significant deficiencies that included the following: lack of segregation of duties in the Sheriff’s Office, including the commissary; incorrect journal entries were posted triggering issues with bank reconciliations; $190,946 in uncollateralized bank deposits at November 30, 2019; maintenance of a tax escrow bank account that was not recorded on the County’s general ledger; lack of new vendor policies and procedures, and Public Health Fund grant allocations not completed timely. Lastly, she went over a 3-year trend analysis of revenue, expenditures, and fund balances. It was moved by Mrs. Offill and seconded to approve the FY2019 Audit. FORMULATING A PLAN FOR OPENING IROQUOIS COUNTY IN REGARD TO THE COVID CRISIS

Chairman Shure opened the discussion on formulating a plan for opening Iroquois County in regard to the COVID crisis. In order to allow the members to voice their opinion on the matter, he called on each Board member individually.

Many of the Board members were in favor of moving forward with opening; however, there were several that wanted to take their time and set up a committee to come up with a plan in order to ensure laws are not violated. It was noted that those business with State licensing could get their license pulled should they be in violation of the Governor’s order. The Public Health Department and Emergency Management Agency could also face the same consequence, as well as losing funding or have funding withheld from the State if the Governor’s order is not followed.

State’s Attorney Jim Devine reviewed the proposed Resolution and plan, however, there is a problem in the fact the County Board does not have the authority to perform the action they are trying to implement. He said they can encourage and make recommendations to legislature or the governor, but they cannot force the Health Department to follow the proposed plan as they take their orders from Springfield. If they don’t follow protocol as set out by the Governor and Illinois Department of Public Health, they could get their license pulled which would then make Springfield in charge of our public health decisions.

Chairman Shure said he didn’t think it is in the County Boards best interest to officially go against the Governor’s orders.

It was moved by Mr. Behrends and seconded to request the Iroquois County Emergency Management Coordinator to collaborate with the local health authority to develop a contingency plan should the Governor’s Restore Illinois Plan be declared invalid or unconstitutional.

At this time Mrs. Crow commented that there should also be input from Board members and others such as business owners in the development of the plan.

EMA Coordinator Eric Ceci said EMA normally seeks input from various entities such as law enforcement, public health, fire and EMS when planning.

Ms. Duby made a motion to amend the previous motion to amend the motion made by Mr. Behrends to include a deadline for the plan to be completed by May 27th with information sought by the community.

Chairman Shure thought the proper way to proceed would be for Mr. Behrends to amend his motion. Mr. Behrends agreed that the timeline of May 27th, 2020 could be added so the plan would be ready for the Policy & Procedure Committee meeting. Mr. Behrends didn’t think with the current situation that it would be feasible to gather input from the community in person, but their input can be received through emails and phone calls. Chairman Shure added that the EMA Coordinator indicated that he will be working with entities representing the community.

It was moved by Mr. Behrends and seconded to request the Emergency Management Coordinator to collaborate with the local health authority to develop a contingency plan should the Governor’s Restore Illinois Plan be declared invalid or unconstitutional with the plan to be developed by May 27, 2020. The Board discussed the solar farm building permit application that was received from the Louis Kay Trust. Mrs. Johnson mentioned the Board should look at modifying the permit application by requesting that some of the work on the solar farms be provided by contractors from Iroquois County. It was moved by Mr. Behrends and seconded to approve the solar farm building permit application as submitted by the Louis Kay Trust. The motion carried by a roll call vote.

BACKPAY FOR TELECOMMUNICATORS

Chairman Shure and ETS Director Eric Raymond spoke about errors that were made on pay for telecommunicators. There were several that were not paid proper holiday pay and three newer hires that were not paid the correct starting wage. Chairman Shure felt the monies to pay the backpay for the telecommunicators should come from the Public Safety Tax Fund. The total to be paid as backpay in the amount of $20,050.50. It was moved by Mr. Alt and seconded to pay the backpay due to the telecommunicators with the money to come from the Public Safety Tax Fund. The motion carried by a roll call vote.

SETTING SALARIES FOR ELECTED OFFICIALS-SPECIFICALLY CORONER

The Board talked about the salaries for the elected officials that will be elected in November. The salaries are required to be set at least 180 days before the beginning of the term. The Coroner’s salary, specifically, is required to be set as the State’s Attorney’s salary is determined by population and the Circuit Clerk’s salary can be amended during their term. A wage history was presented. Chairman Shure said the Coroner agreed that the first proposal of $750 was acceptable with the anticipated loss of revenue to the County, however, there were also 2% and 2.5% increases presented. Mr. Bohlmann said the 2.5% increase, option #3, would amount to about $5.00 more per week; therefore, he moved to accept option #3 on the proposal. The motion was seconded and carried by a roll call vote.

The Board discussed Resolution No. R2020-6, a Resolution Postponing Delinquency Date Interest for the First Installment 2019 (Payable 2020) Property Tax Payments. It was confirmed that this is not part of the Governor’s Executive Order and the interest will be waived on the first installment; however, if the taxes are not paid by the second installment due date, all of the interest will be charged retroactively. It was moved by Mr. Bohlmann and seconded to approve Resolution No. R2020-6. The motion carried by a roll call vote.

RESOLUTION

RESOLUTION POSTPONING DELINQUENCY DATE INTEREST FOR THE FIRST INSTALLMENT 2019 (PAYABLE 2020) PROPERTY TAX PAYMENTS PURSUANT TO 35 ILCS 200/21-40(C)(1)(B)

WHEREAS, County residents and property tax owners currently face an unprecedented health crisis due to the COVID-19 global pandemic; and

WHEREAS, as a result of the COVID-19 global pandemic and resulting Illinois Executive Orders requiring the closure of certain businesses and requiring that individuals “stay at home”, numerous County residents, small business owners, and retail establishments have expressed concern regarding their ability to pay their property tax obligations in a timely fashion; and

WHEREAS, significant restrictions currently exist regarding payment methods; and

WHEREAS, in response to the outbreak of COVID-19, the State of Illinois declared all counties in the State a disaster area by Executive Order of the Governor on March 20, 2020 and on March 26, 2020, an Illinois disaster declaration was approved by the President of the United States; and

WHEREAS, the Illinois Property Tax Code at 35 ILCS 200/21-40(C)(1)(B) permits a county board to adopt an ordinance or resolution modifying certain provisions of the Property Tax Code where that county has been designated a disaster area by the President of the United States or the Governor of the State of Illinois upon certain conditions being met.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNTY BOARD OF IROQUOIS COUNTY, ILLINOIS THAT: the real property in the County of Iroquois has been adversely affected by the COVID-19 global pandemic; therefore, on the recommendation of the County Treasurer, the penalty of interest shall be postponed for the first installment of property taxes for the 2019 (payable 2020) taxable year that otherwise would be imposed under Section 21-15, 21- 20, or 21-25 of the Illinois Property Tax Code, provided the taxpayer pays the full amount of all property taxes for the 2019 (payable 2020) taxable year on or before the September 1st, 2020 due date, at which time such penalties shall be waived. Failure to pay first installment of 2019 (payable 2020) tax year property taxes by September 1st, 2020, will result in full application of applicable penalties pursuant to the Property Tax Code retroactive to the July 1 due date. This resolution does not amend the due dates for the first or second installments of 2019 (payable 2020) tax year property taxes.

BE IT FURTHER RESOLVED, notwithstanding this Resolution, all escrowed property tax payments are not subject to this Resolution and are still required to be paid on or before the required due dates.

A.M. Members present were Charlie Alt, Joe Young, Steve Huse, Donna Crow, Sherry Johnson and Chad McGinnis. John Zumwalt was absent. Also present County Engineer Joel Moore and Wendy Davis with the Times Republic.

The meeting was called to order.

There were no public comments.

It was moved by Chad McGinnis and seconded by Joe Young to approve the agenda.

Motion carried by a voice vote.

County Engineer Joel opened bids for the County wide striping contract. They are as follows:

It was moved by Sherry Johnson and seconded by Donna Crow to approve the bid from Varsity Striping in the amount of $32,322.50 pending bid tab review. A roll call vote was taken.

Motion carried.

Moore opened bids for the Crescent Road District stockpile. They are as follows:

• Conrad Trucking $55,450.00

• Weber Trucking $52,950.00

• C & C Trucking $53,100.00

It was moved by Young and seconded by Johnson to approve the bid from Weber Trucking in the amount of $52,950.00 pending bid tab review. A roll call vote was taken.

The claims and financial reports for the month were reviewed. It was moved by Johnson and seconded by McGinnis to pay the bills subject to County Board approval. A roll call vote was taken. Motion carried.

Regarding budget concerns, McGinnis discussed articles he has been reading that state

local government should prepare to have a 15%-30% reduction in state share of taxes. McGinnis asked Moore how he is preparing for the lack of funds. Moore explained when he prepared for the budget, they were anticipating a 68% increase because of the additional Motor Fuel Tax funds. However, he didn’t include the additional funds in the budget because he hadn’t seen enough of the funds during budget preparation time.

The state line bridge agreements for Benton County and Newton County were distributed to the committee for review. It was moved by Steve Huse and seconded by McGinnis to approve the state line bridge agreements for Benton County and Newton County. Motion carried by a voice vote.

Moore discussed the Local Public Agency Agreement for Federal Participation to use STR funds to re-pave 700 East (Lehigh Road). The estimated cost is $1,450,000. Our portion is $290,000 from Matching Tax funds. It was moved by McGinnis and seconded by Crow to approve the Resolution to use Matching Tax funds to re-pave 700 East (Lehigh Road) in the amount of $290,000. A roll call vote was taken. Motion carried.

The HSIP Guardrail improvement was discussed. The estimated cost for the improvement is $1.5 million with $550,000 being the County’s portion. It was moved by Young and seconded by Huse to approve the Resolution to use Matching Tax funds in the amount of $550,000 for HSIP Guardrail improvement. A roll call vote was taken. Motion carried.

Moore presented a Preliminary Engineering Agreement for Township bridge inspections. This is an annual agreement that is not to exceed $45,377. It was moved by Huse and seconded by McGinnis to approve the annual Preliminary Engineering Agreement for Township bridge inspections, not to exceed $45,377. A roll call vote was taken. Motion carried.

There was no new business.

There was no old business.

As there was no further business to come before the committee, it was moved by Young and seconded by Huse to adjourn at 9:36 A.M. Motion carried by a voice vote. All of which is respectfully submitted.

Patricia King of 1990 N 2500 East Rd, Watseka, IL as Trustee of the Concord Fire Protection District for a term to expire on the first Monday of May, 2023.

Mr. Alt commented that the Veterans Administration has delayed their semi-annual meeting that was scheduled in May.

Chairman Shure affirmed that efforts are being made to hold the June County Board meeting in person.

It was moved by Mr. Behrends and seconded to adjourn the meeting at 11:08 A.M. The motion carried by a voice vote. The next County Board meeting will be held in Watseka, IL on Tuesday, June 9, 2020 at 9 A.M.
