Village of Chebanse Village Board met June 17.

Mayor Mathy called the regular Village Board meeting to order at 7:00 pm and announced that the Village would be taping and Kathy Washington from the Advocate would be taking notes.
The following Trustees were present: Trustee Beherns, Trustee Kohler, Trustee Odle, Trustee Perzee, Trustee Randles and Trustee Snyder. Also present were Mayor Mathy, Clerk Pasel, Attorney Hiatt and James Smith from Maintenance.

APPROVAL OF REGULAR MINUTES: A motion was made by Trustee Perzee and a second by Trustee Snyder to approve the May 20, 2019 Village Board meeting minutes. Vote:

UNFINISHED BUSINESS: NONE REPORTS OF COMMITTEES: NONE
REPORTS OF VILLAGE OFFICERS: Clerk Pasel stated that after looking through our new code, she could not find any reference that the Village has also adopted the 2006 ICC Codes. She asked if the Board would like to have reference to the 2006 ICC Code. Response was yes. Clerk Pasel will draft an ordinance for the Boards consideration.
Clerk Pasel reported the cost of the Village’s liability insurance for next year would remain at the 2019 rate. Clerk Pasel reported that the process for recodification of our codebook would not be as lengthy of a process as the last one. From this point on, when there is an amendment of any ordinance or an addition of an ordinance, the cost would be $22.00 per codebook page affected. Additionally we will pay $500.00 per year to have our code online.
James stated that our summer help is working very well. James also reported that the Pickleball court is a big hit.
NEW BUSINESS:
HOMECOMING: Homecoming Chairperson April Perzee stated that there are still a lot of Golf Cart tickets that need to be sold. We printed 500 tickets.170 are either signed out to people or sold. Mayor Mathy asked if the parade was changed to Saturday night. April responded yes, she forgot about the game on Friday night so the parade will be Saturday night. Mayor Mathy asked if the bands had been booked. Response was yes, they are all booked. Vendor booths are starting to come in as well. James informed the Board that he is bringing the Golf Cart up to Village Hall during the day, which seems to be helping with selling tickets. James stated that the Legion would be doing a fish fry on Friday night.
WATER LINES: A motion was made by Trustee Perzee and a second by Trustee Odle to install a water line at lift station #1, not to exceed $4,000.00. Vote:

FENCING: Mayor Mathy stated that a resident has asked about installing a privacy fence from the sidewalk to the back of the property. Mayor Mathy stated that he has researched our building ordinance and zoning ordinance and cannot find anything that opposes installing a privacy fence from the sidewalk to the back of the property. Trustee Beherns asked if section 10.4-3, subsection b was referenced. (residential fences are permitted on the property lines in residential districts and shall not be closer than 2’ to the public right-of-way). Yard requirements stipulated elsewhere - accessory uses and detached accessory structures are permitted in the rear and side yards only. They shall not be closer than 10’ to the principal structure, shall not exceed 15’ in height, shall not occupy more than 30% of the rear and side yard area and shall not be closer than 5’ from the lot line. Mayor Mathy asked our attorney what we should reference. Attorney Hiatt responded that it would be the zoning regulations. Trustee Beherns stated that if an 8’ fence was installed all the way up to the sidewalk, it becomes a safety issue. Mayor Mathy would like clarification so our Building Inspector knows how to reply. Trustee Beherns stated that in his opinion, the response to the resident should be our interpretation is that you cannot put a fence all the way into the right-of-way. The Board is looking into it for clarification and a definite answer will be provided at the July 15, 2019 meeting. Mayor Mathy stated that we need clarification on a privacy fence verses a mess fence, and from the front of the house to the sidewalk, for the next meeting.
ORDINANCE NO. 19-05 AN ORDINANCE REGARDING FENCES AND LATCHING GATES SURROUNDING SWIMMING POOLS: State law says that if your pool is 42” or higher you are not required to fence around your pool. Mayor Mathy stated that there still has to be a barrier. Trustee Beherns stated that we need to add, the ladder should be removed from the pool and you must have a self-closing and self- latching gate. Attorney Hiatt will make the changes and have the ordinance for next meeting.
